Patient’s Right to Know Act Went Into Effect July 1, 2019

California has become the first state in the U.S. to implement a major new misconduct disclosure requirement. Senate Bill SB1448 (Patient’s Right to Know Act) requires that doctors notify their patients if placed on probation for sexual misconduct, alcohol or drug abuse, inappropriate prescriptions, or criminal convictions that involve harm to a patient.

Starting July 1, 2019, disciplined doctors have to obtain a signed disclosure from all patients before their next appointment. The written disclosure must include:

  1. The doctor’s probation status.

  2. All practice restrictions placed on the licensee by their licensing board.

  3. The length of the probation and when it will end.

  4. Instructions on how the patient can obtain further information about the licensee’s probation on their licensing board’s website.

The licensing boards will also enhance the disclosures they display on the licensee’s website profile page.

Who is Subject to California’s New Disclosure Rules?

California’s Patient’s Right to Know Act applies to all healing arts licensees, including those licensed by:
